TOMORROW NEVER KNOWS (TNK) FESTIVAL SWEEPSTAKES. Hotel Zachary at Gallagher Way, also known as HSC Plaza and Building Operations, LLC d/b/a Hotel Zachary, (“Sponsor”) is hosting a sweepstakes where one (1) randomly selected winner will receive one pair of tickets to a TNK '24 show of their choosing, along with a one-night stay at Hotel Zachary (must be redeemed for the night of the show of their choosing). The TOMORROW NEVER KNOWS (TNK) FESTIVAL will take place at Lincoln Hall, Schubas, Sleeping Village, and Gman Tavern from Jan 17-21, 2024 (“Prize”) (exclusions apply). Randomly selected winner is allowed to select which show they would prefer to attend from the list of available locations/shows.

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT WILL NOT INCREASE AN ENTRANT’S CHANCES OF WINNING. ODDS OF WINNING WILL DEPEND OF THE TOAL NUMBER OF ELIGIBLE ENTRIES RECEIVED. THIS SWEEPSTAKES IS OPEN ONLY TO LEGAL RESIDENTS OF THE STATE OF ILLINOIS. VOID WHERE PROHIBITED BY LAW. ALL DISPUTES WILL BE RESOLVED SOLELY BY BINDING ARBITRATION AND ENTRANTS WAIVE THE ABILITY TO BRING CLIAMS IN A CLASS ACTION FORMAT. This Sweepstakes is governed by these official rules (“Official Rules”). By participating in the Sweepstakes and submitting an entry, each entrant agrees (1) to be bound by these Official Rules, including all eligibility requirements and (2) they understands that the results of the Sweepstakes, as determined by Sponsor and its agents, are final in all respects. The Sweepstakes is subject to all federal, state and local laws and regulations and is void where prohibited by law.
This promotion is in no way sponsored, endorsed or administered by, or associated with Instagram, Facebook, TikTok or Twitter. Any questions, comments or complaints regarding the promotion will be directed to Sponsor, not Instagram, Facebook, TikTok, or Twitter.
SWEEPSTAKES PERIOD: The Sweepstakes entry period begins Friday, January 12 at 12:00 p.m. CT. Entries close Monday, January 15 at 5:00 p.m. CT. One winner will be selected on Monday, January 15. (“Entry Period”). All entries (submissions) must be received during the Sweepstakes Period. Sponsor reserves the right to extend or shorten the sweepstakes at their sole discretion. Winner will be contacted via direct message via the Instagram handle that they used to enter.
ELIGIBILITY: The Sweepstakes is open only to legal residents of the state of Illinois, who at the time of entry are twenty-one (21) years of age or older. Employees, officers and directors (including immediate family members (spouse, parent, child, sibling and their respective spouses, regardless of where they reside), and members of the same household, whether or not related, of Sponsor, Davidson Hotel Company LLC d/b/a Davidson Hospitality Group, and each of their respective parents, affiliated companies, subsidiaries, advertising and promotion agencies, and suppliers, and any and all other companies associated with the Sweepstakes (“Sweepstakes Entities”) are not eligible to participate in the Sweepstakes. The Sweepstakes is subject to all applicable federal, state, territory, provincial and local laws, rules and regulations. Void where prohibited or restricted by law, rule or regulation.
AGREEMENT TO RULES: By participating, the entrant (“You”) agree to be fully, unconditionally bound by these Official Rules, and You represent and warrant that You meet the eligibility requirements. In addition, You agree to accept the decisions of Sponsor as final and binding as it relates to the content of this Sweepstakes.
HOW TO ENTER: To enter the Sweepstakes:
1) Tag a friend in the Sweepstakes post.
2) Comment which show you want to attend.
3) Visit @tnkfest, @hotelzachary and the venue pages (listed within the launch post via TNKFest’s page).
Incomplete and/or inaccurate entries are void. Only entries successfully submitted and received by Sponsor during the Entry Period are eligible. Limited one (1) entry per person/e-mail address, however. All information submitted online by entrants is subject to, and will be treated in a manner consistent with, Sponsor’s and Hotel Zachary’s Terms of Use and Privacy Policies (https://www.hotelzachary.com/privacy-policy). No other method of entry will be accepted.
WINNER SELECTION: On Monday, January 15, 2024, one (1) potential winner of the Sweepstakes will be selected by random drawing from among all eligible entries received during the Entry Period and notified via the Instagram page provided at the time of entry. Subject to verification of eligibility and compliance with the terms of these Official Rules, potential winners will be declared the official winner of the Sweepstakes (each a “Winner” and collectively “Winners”). The decisions of Sponsor are final and binding on all matters related to this Sweepstakes. Odds of winning depend on the total number of eligible entries received.
NOTIFICATION: One (1) potential winner will be notified by email via the email address provided at the time of entry (“Prize Notification”). In the event the potential winner(s) does not respond to any such Prize Notification within twenty-four (24) hours of the time of issuance or declines the Prize (as defined below) for any reason, the Prize will be forfeited and, at Sponsor’s sole discretion, an alternate potential winner of the Prize may be randomly selected from among all remaining eligible entries. The potential winner(s) may be required to submit his/her valid photo identification to Sponsor and may be required to execute, have notarized and return an Affidavit of Eligibility and Release of Liability and, unless prohibited by law, Publicity, within five (5) days of the date of issuance. Failure to submit any identification required by Sponsor or to return the required documents within the specified time period, noncompliance with these Official Rules or the return of the Prize (or any portion thereof) or Prize Notification as undeliverable may result in disqualification and Prize forfeiture and, at Sponsor’s sole discretion and time permitting, may cause an alternate potential winner of the applicable Prize to be randomly selected from among all remaining eligible entries.
PRIZE: One (1) winner will receive one pair of tickets to a TNK '24 show of your choosing to the TOMORROW NEVER KNOWS (TNK) FESTIVAL Concert at Lincoln Hall, Schubas, Sleeping Village, Gman Tavern on Jan 17-21, 2024, and a one-night stay at Hotel Zachary on the night of the selected show.

PRIZE CONDITIONS: All costs and expenses associated with Prize acceptance and use not specified herein as being provided, including but not limited to transportation costs, meals (except as noted herein), gratuities and other expenses incurred by accepting the Prize is the sole responsibility of the Winners and their guests. All prize details shall be determined in the sole and absolute discretion of Sponsor. The Winner’s guests must be twenty-one (21) years of age or older. The Winner and his/her guests agree to comply with all applicable Sponsor and venue rules and regulations in connection with the Prizes. Sponsor reserve the right to remove or to deny entry to the Winner and/or his/her guests who engage disruptive manner, or with intent to annoy, abuse, threaten or harass any other person at the game, event or exhibition. The Prize is non-transferable and non-assignable, with no cash redemptions. Sponsor reserves the right to substitute an element of the Prize with a prize of comparable or greater value at its sole and absolute discretion. Acceptance of Prize constitutes permission for Sponsor and the participating retailer to use Winner’s name, address (city and state), biographical information, likeness, picture, voice, statements, entry, and other information and content provided in connection with the Sweepstakes for purposes of advertising and trade in all media worldwide, including, but not limited to, on television and the Internet, without further compensation or notification, unless prohibited by law. Terms and conditions may apply. Incidental expenses and all other costs and expenses which are not specifically listed as part of the Prize and which may be associated with the award, acceptance, receipt and use of all or any portion of the awarded Prize are solely the responsibility of the respective Winner. ALL FEDERAL, STATE AND LOCAL TAXES ASSOCIATED WITH THE RECEIPT OR USE OF ANY PRIZE IS SOLELY THE RESPONSIBILITY OF THE WINNER.
Winner agrees that acceptance of the Prize is done so entirely upon their own initiative, risk, and responsibility.
ADDITIONAL LIMITATIONS: No substitution or cash equivalent of Prize is permitted. The Released Parties (as defined below) are not responsible for any typographical or other errors in the offer or administration of the Sweepstakes, including, but not limited to, errors in any printing or posting or these Official Rules, the selection and announcement of any winner, or the distribution of any prize. Any attempt to damage the content or operation of this Sweepstakes is unlawful and subject to possible legal action by Sponsor. Sponsor reserves the right to terminate, suspend or amend the Sweepstakes, without notice, and for any reason, including, without limitation, if Sponsor determines that the Sweepstakes cannot be conducted as planned or should a virus, bug, tampering or unauthorized intervention, technical failure or other cause beyond Sponsor’s control corrupt the administration, security, fairness, integrity or proper play of the Sweepstakes. In the event that any tampering or unauthorized intervention may have occurred, Sponsor reserves the right to void suspected entries at issue. Sponsor and its respective parent, affiliate and subsidiary companies, agents, and representatives, and any telephone network or service providers, are not responsible for incorrect or inaccurate transcription of entry information, or for any human error, technical malfunction, lost or delayed data transmission, omission, interruption, deletion, line failure or malfunction of any telephone network, computer equipment or software, the inability to access any website or online service or any other error, human or otherwise.
CONTENT RESTRICTIONS: Entrants must not include any of the following content (the “Content Restrictions”) in any Entry: (a) pornography, adult-oriented content or any other sexually-explicit material; (b) materials relating to lotteries or gambling; (c) explicit language or content, images of violence, or promotion of illegal activities; (d) content in violation of intellectual property rights or laws; (e) libelous, defamatory, disparaging, tortious or slanderous materials; (f) tobacco, e-cigarettes, alcohol or drugs; (g) dangerous stunts; (h) real weapons of any kind including, but not limited to, guns, knives or projectiles; (i) material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation, age or any other basis protected by federal, state, territory, provincial or local law, ordinance, or regulation; (j) individuals under legal age of majority without providing a signed release from parent or legal guardian; (k) audio and/or visual content owned by any third party (e.g., recorded music; pre-produced video, etc.); and (l) material that is unlawful, or otherwise in violation of or contrary to the laws or regulations in any state/territory/province where the Entry is created or the regulations, guidelines, or policies of the platform used (i.e., ViralSweep). Any Entry that does not comply with the foregoing, in the sole discretion of Sponsor, will be disqualified and eliminated from the Sweepstakes.
INDEMNIFICATION AND LIMITATION OF LIABILITY: By entering the Sweepstakes, each entrant agrees to (a) be bound by these Official Rules, and (b) indemnify, release and hold harmless the Sweepstakes Entities and all their respective officers, directors, employees, representatives, agents, licensees (collectively, “Released Parties”) from any liability, damage, loss or injury resulting in whole or in part, directly or indirectly, from entrant’s participation in the Sweepstakes and the acceptance, use or misuse of any Prize that may be won. The entrant agrees to forever and irrevocably agree to release and hold harmless each of the Released Parties from any and all claims, lawsuits, judgments, causes of action, proceedings, demands, fines, penalties, liability, costs and expenses (including, without limitation, reasonable attorneys’ fees) that may arise in connection with: (a) the Sweepstakes, including, but not limited to, any Sweepstakes-related activity or element thereof, and the entrant’s entries, participation or inability to participate in the Sweepstakes; (b) the violation of any third-party privacy, personal, publicity or proprietary rights; (c) acceptance, attendance at, receipt, travel related to, participation in, delivery of, possession, defects in, use, non-use, misuse, inability to use, loss, injury, damage, destruction, negligence or willful misconduct in connection with the use of the Prize (or any component thereof); (d) any change in the prizing (or any components thereof); (e) human error; (f) any wrongful, negligent, or unauthorized act or omission on the part of any of the Released Parties; (g) lost, late, stolen, misdirected, damaged or destroyed prizing (or any element thereof); or (h) the negligence or willful misconduct by entrant. The Released Parties do not make any warranties, express or implied, as to the condition, fitness or merchantability of any element of the Prize. The Released Parties disclaim any liability for damage to any computer system resulting from access to or the download of information or materials connected with the Sweepstakes.
GENERAL CONDITIONS: As a condition of entering this Sweepstakes, each entrant agrees that (i) any and all disputes, claims, controversies or causes of action arising out of or relating to this Sweepstakes, or any prizes awarded (each, a "Claim"), shall be (1) arbitrated on an individual basis only, and shall not be consolidated or joined with or in any arbitration or other proceeding involving a Claim of any other party, and (2) settled by binding arbitration in Cook County, Illinois before a single arbitrator appointed by the JAMS in accordance with its then governing rules and procedures, and judgment on the award rendered by the arbitrator may be entered by any court having jurisdiction thereof; and (ii) under no circumstance will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental, consequential or any other damages, other than for actual out-of-pocket expenses. These Official Rules shall be governed by and construed and interpreted in accordance with the laws of the State of Illinois, U.S.A, applicable to contracts entered into and performed exclusively in that State.
Released Parties are not responsible for any technical, computer, network, typographical, printing, human or other errors relating to or in connection with this Sweepstakes, including, without limitation, errors or problems which may occur in connection with the offer or administration of this Sweepstakes, the processing of entries, the tabulation of scores, the cancellation of games or any errors appearing in any Sweepstakes-related materials including, but not limited, to errors in advertising, the Official Rules, the selection and announcement of the Winner or the distribution of the Prize. Sponsor reserves the right to modify these Official Rules for clarification purposes without materially affecting the terms and conditions of the Sweepstakes.
Released Parties make no warranties, express or implied, relative to the use or enjoyment of the Prize (or any portion thereof) including, without limitation, its quality, merchantability or fitness for a particular purpose. By entering the Sweepstake, each participant agrees to indemnify, hold harmless and fully release the Released Parties from any and all claims, demands, losses, promises, causes of action and/or liabilities for any injuries, losses, death, or damages of any kind caused, directly or indirectly, in whole or in part, by participation in, or preparation for, the Sweepstake, Sweepstake-related activity, participant’s Entry, or resulting from the acceptance, possession, quality, use or misuse of the Prize (or any portion thereof) including any travel or activity related thereto.
If the Sweepstakes is not capable of running as planned for any reason including, without limitation, as a result of infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, , or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Sweepstakes, Sponsor reserves the right, at its sole and absolute discretion, to cancel, terminate, modify or suspend the Sweepstakes, to disqualify any individual who tampers with the entry process, and, if terminated, to determine the Winner, if any, from among all eligible, non-suspect Entries submitted up to the point of termination.
Released Parties assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. The Released Parties are not responsible for any problems or technical malfunction of any telephone network, cable, satellite, wireless, Internet Service Provider (ISP) or lines, computer systems, servers, or providers, computer equipment, software, malfunctions of wireless devices, wireless service problems, cellular tower equipment, failure of any email or entry to be received on account of technical problems or traffic congestion on the Internet or at any website or wireless service congestion, or any combination thereof, including any injury or damage to participant's or any other person's computer or mobile device related to or resulting from participation or downloading any materials in this Sweepstakes.
CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE ASSOCIATED WITH THIS SWEEPSTAKES OR UNDERMINE THE CONTENT OR LEGITIMATE OPERATION OF THIS SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR WILL DISQUALIFY ANY PARTICIPANT RESPONSIBLE FOR THE ATTEMPT, AND SPONSOR, AND THEIR RESPECTIVE AGENTS RESERVE THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEYS' FEES) AND OTHER REMEDIES FROM ANY PERSON OR PERSONS RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.
In the event the Sweepstakes is challenged by any legal or regulatory authority, Sponsor reserves the right to discontinue or modify the Sweepstakes, or to disqualify participants residing in the affected geographic areas. In such event, the Released Parties shall have no liability to any participant who is disqualified due to such an action.

This Sweepstakes may not be used for, or in connection with, any form of gambling.
